Terms of Service
These terms are the agreement between you and FollowThru for using the followthru app, the web app and this website. We've kept them as plain as we can.
By ticking the box when you sign up, or by using FollowThru, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use FollowThru.
1. The agreement
FollowThru (“we”, “us”) is run by FOLLOWTHRU PTY LTD (ABN 39 703 644 964), based in Australia. FollowThru is a tool: it helps coaches run their coaching and helps golfers book and keep track of lessons. Lessons themselves are between the coach and the golfer. We aren't a party to them and we don't employ or supervise coaches.
We may update these terms. If a change matters, we'll tell you in the app or by email at least 30 days before it takes effect. If you keep using FollowThru after that, the new terms apply; if you don't agree, you can close your account.
2. Your account
- You need to be 13 or over. If you're 13 to 17, a parent or guardian must agree to you using FollowThru. Children under 13 can be booked for by a parent or guardian from their own account.
- If you're 13 to 17, you can book and manage your lessons yourself, but messages with coaches go through your parent or guardian's account, linked to yours, and they can see them.
- Give us accurate details, and keep your password and phone to yourself. You're responsible for what happens on your account.
- One account per mobile number for each of coach and golfer. We text a code to check the number is yours.
- Tell us straight away at the address below if you think someone else has used your account.
3. Coaches
If you coach on FollowThru:
- You run your own business. You set your prices, hours and cancellation and credit approach, and you're responsible for your lessons, your qualifications, insurance, safety and tax.
- You're the seller of your lessons, not FollowThru. If a golfer is owed a remedy for a lesson under consumer law, such as a refund for a lesson you didn't give, that's for you to provide. FollowThru doesn't refund lessons (see section 6).
- If a golfer's bank reverses a card payment for one of your lessons, that comes back from you, as set out in section 6 (Disputed payments).
- You need permission to record people. Before filming or photographing a client, make sure they agree, and for anyone under 18, that a parent or guardian agrees.
- If you coach anyone under 18: hold any check the law requires where you coach (such as a Working With Children Check in Australia or a DBS check in the UK), follow your golf body's safeguarding policy, keep messages with under-18s to their coaching and lessons, and include their parent or guardian for anything else.
- You're responsible for the information you keep about your clients, and for following the privacy laws that apply to you. We look after it on your behalf, only to provide FollowThru, as set out in section 7 and our Privacy Policy.
- Only message clients about their coaching, and don't add people to FollowThru without a good reason to (for example, they've booked or asked you to).
4. Coach plans and billing
- Coaches need a paid plan. Every plan starts with a 2-week free trial (1 month if another coach referred you with their code). You add your card when you sign up.
- When the trial ends, your card is charged for your first month, and then every month on the same date until you cancel. We'll show you the charge date when you sign up and in your plan details.
- Your price depends on the country of the mobile number you signed up with, in that country's currency, plus any tax that applies.
- Cancel any time in the web app (Settings, then Manage subscription). Your plan stays on until the end of the month you've paid for and then stops. We don't refund part months, unless the law requires it.
- If a payment fails, we'll let you know and try again. If it still can't be paid, your account may be paused until it is. Your information isn't deleted.
- Referrals: if coaches you refer become paying coaches, you can earn free months as described in your plan details. A free month starts from your next payment date.
- If we change plan prices, we'll tell you at least 30 days before it affects you, and you can cancel before then.
5. Golfers and lessons
- FollowThru is free for golfers. You can book, pay for and keep track of lessons with any coach on FollowThru.
- Your lesson is with your coach. Lesson times, what's covered, and whether you can reschedule or get a credit are up to your coach.
- If you book for someone else, such as your child, you confirm you're allowed to, and that you agree to their coach recording photos and videos of them in lessons.
6. Lesson payments, booking fees and refunds
- When you pay for a lesson in the app, the payment goes straight to your coach through Stripe. Your coach receives the full lesson price.
- Paying in the app adds a booking fee, shown at checkout before you pay. The booking fee goes to FollowThru and covers card processing and running the service. If you pay your coach another way, such as cash or bank transfer, there's no booking fee.
- Coaches who take card payments agree to Stripe's terms, including the Stripe Connected Account Agreement. Stripe pays coaches directly, and the coach is the seller of their lessons.
Refund policy
- Lessons are between the golfer and the coach. FollowThru provides the app you book and pay through; we don't sell lessons and we aren't a party to them.
- Lessons paid for in the app are non-refundable, and FollowThru doesn't give refunds. This includes the booking fee.
- If you can't make a lesson you've paid for, your coach can move it to another time that suits you both, or may give you a lesson credit to use later. Whether to give a credit is up to your coach.
- If your coach cancels a lesson you paid for in the app, you get it back as a lesson credit with that coach.
- Payments made outside the app, such as cash or bank transfer, are between you and your coach.
- Any disagreement about a lesson, a payment or a credit is between the golfer and the coach. We're happy to help where we can, but we aren't responsible for resolving it, and we aren't liable for it.
Disputed payments (coaches)
- A golfer can ask their bank to reverse a card payment (a dispute or chargeback). The bank takes the money back through FollowThru's Stripe account, but you're the seller, so if the bank decides for the golfer, it comes back from you.
- When a dispute is opened, nothing is taken from you while the bank decides. We'll tell you straight away. Some banks first ask questions about a payment (an inquiry); an inquiry doesn't take any money.
- We answer the bank for you with the lesson's record (the booking, the payment terms the golfer agreed to, your lesson report, swing videos and messages). Please send us anything else that would help when we ask.
- If the bank decides for you, you keep the payment. If it decides for the golfer, or we accept the dispute because it can't reasonably be won, what you received for that payment (your lesson price, not the booking fee) is taken back from your Stripe account. If your Stripe balance can't cover it, it comes off your later card payments through FollowThru.
- Stripe charges fees for each dispute (A$25 in Australia at the time of writing) and only gives part back if the bank decides for you. What's left of Stripe's dispute fees comes off your next card payment through FollowThru. If the bank decides for the golfer, so does the card processing fee Stripe kept on the original payment, because the whole payment, booking fee included, goes back to the golfer.
Your rights under consumer law
Nothing in these terms takes away rights you have under consumer protection laws that can't be excluded, such as the Australian Consumer Law, New Zealand's Consumer Guarantees Act, the UK Consumer Rights Act or EU consumer law, and the refund policy above doesn't either. Where those laws give you a refund or other remedy for a lesson, it's owed by your coach, as the seller of the lesson. For the booking fee and the app itself, it's owed by us.
7. Your content
- What you put into FollowThru, such as notes, swing videos, photos and messages, stays yours.
- You give us permission to store, copy, process and show it, only as needed to run FollowThru for you and the people you share it with. This permission ends when you delete it or your account, apart from copies in backups that clear on their normal cycle.
- Only add content you have the right to, and that the people in it have agreed to.
- For coaches: we process your clients' information only on your instructions and to provide FollowThru; we keep it confidential and secure; we use the providers listed in our Privacy Policy, under contracts that protect it; we'll help you answer your clients' privacy requests; we'll tell you without undue delay if there's a breach affecting it; and we'll delete it when you delete your account. Ask us if you need a separate data processing agreement.
8. Using FollowThru fairly
We have zero tolerance for objectionable content and abusive behaviour. Please don't:
- post or send anything unlawful, threatening, harassing, hateful, sexually explicit, or that invades someone's privacy;
- contact people who haven't asked to hear from you, or send spam;
- pretend to be someone else, or use someone else's account;
- try to break, overload, copy, scrape or reverse engineer FollowThru, or get around its security or plan limits.
In any chat you can block the other person, or report a message or the person to us, from the ⋯ button at the top (or by holding a message). You can also email [email protected]. We look at every report, usually within a day, and may remove content, or pause or close an account, that breaks these terms or puts others at risk. Where it's fair to, we'll tell you first and give you a chance to fix it. If someone is in danger, contact the police or emergency services first.
9. The app and app stores
We give you a personal, non-transferable right to use the followthru app on devices you own or control, under these terms. FollowThru, its design and its software belong to us.
If you downloaded the app from Apple's App Store
- These terms are between you and FollowThru, not Apple. FollowThru, not Apple, is responsible for the app and its content.
- Apple has no duty to provide maintenance or support for the app.
- If the app doesn't meet a warranty that applies, you can tell Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation for the app, to the extent the law allows.
- FollowThru, not Apple, is responsible for handling any claims about the app, including product liability, failing to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- If anyone claims the app infringes their intellectual property, FollowThru, not Apple, is responsible for dealing with it.
- You confirm you're not in a country subject to a US government embargo or listed as a terrorist-supporting country, and you're not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
If you downloaded it from Google Play
Google Play's terms also apply to your download. Google isn't responsible for the app.
10. Our responsibility to you
- We work hard to keep FollowThru running and your information safe, but we can't promise it will always be available or free of errors. We may change or improve features over time.
- We aren't responsible for lessons, or for what coaches or golfers do or say. Disagreements about a lesson are between the coach and the golfer, though we're happy to help if we can.
- To the extent the law allows, we aren't liable for indirect losses (such as lost profits or lost business), and our total liability to you is limited to what you paid us in the 12 months before the claim (for golfers, the booking fees you paid), or A$100 if that's more.
- None of this limits liability that can't legally be limited, such as for our negligence causing death or personal injury, fraud, or your rights under consumer law.
- Coaches agree to cover our reasonable costs if a claim is made against us because of their lessons or a breach of these terms by them.
11. Ending your account
You can delete your account any time in the app (in your account or Settings). It's hidden straight away and deleted for good after 30 days, in case you change your mind. Coaches: delete or cancel and your plan stops at the end of the month you've paid for. We may close accounts that seriously or repeatedly break these terms, or that have been unused for a long time (we'll email you first).
12. General
- These terms are governed by the laws of New South Wales, Australia. If you live elsewhere as a consumer, you keep the protection of your own country's mandatory laws and can bring a claim where you live.
- If part of these terms can't be enforced, the rest still applies. If we don't enforce something straight away, we can still enforce it later.
- These terms and our Privacy Policy are the whole agreement between us about FollowThru.
Questions about these terms: [email protected].
